The US International Trade Commission (ITC) has rejected LG Energy Solution’s request to throw out a patent lawsuit filed against it by SK Innovation.
ITC notified the pair of its decision on March 5, it was revealed on Thursday.
SK Innovation filed the lawsuit back in September 2019, claiming LG Energy Solution infringed its patents.
On Wednesday, the commission made a preliminary determination on LG Energy Solution’s patent lawsuit against SK Innovation. It ruled that SK didn’t infringe on LG’s patents.
On Friday, SK Innovation said ITC’s decision to reject LG’s request to have its patent lawsuit thrown out proves that LG’s arguments that SK deleted its own documents was baseless.
LG Energy Solution said ITC’s latest decision was a common happening in lawsuit and didn’t effect the core of the pair’s lawsuit.
The final determination on SK’s patent lawsuit against LG will be made in July.
The pair’s legal dispute started when LG Energy Solution filed lawsuit claiming SK Innovation stole its trade secrets on April 2019. SK retaliated by claiming LG violated its patents in September of the same year.
